1) Definitions and scope of service

"Sand" refers to the company that owns the platform and the website sndfinancial.com, and "the Platform" refers to Sand's multi-tenant cloud system for managing and running tourism, travel, hotel, residential unit, and related businesses.

Services include, without limitation, booking management, tax invoicing, financial accounts and reports, operational modules (hotels, packages, visas, flights, car rental, transport), and user and permission management.

2) Eligibility and registration

• The user must be legally authorized to represent the establishment registered on the platform.
• The user agrees to provide accurate and up-to-date information when creating an account or accepting an invitation to join the tenant (company).
• The user is responsible for protecting their login credentials and not sharing them with unauthorized parties, and for all activity carried out through their account.
• Sand may suspend or disable any account suspected of misuse or violation of these terms or the regulations in force in the Kingdom of Saudi Arabia.

3) Subscription, billing, and acceptable use

The platform is offered according to subscription plans published on the website or through custom offers. Limits, modules, and permissions may vary according to the agreed plan.

• Using the platform for any unlawful purpose, or in violation of Zakat, tax, and customs regulations, or tourism and commerce regulations, is prohibited.
• Attempting to breach the platform, misuse its APIs, upload harmful content, or infringe the rights of others is prohibited.
• The financial and operational data entered by the client remains their responsibility in terms of accuracy and completeness for accounting and tax reporting purposes.
• Sand is a supporting operations and accounting tool; it does not on its own replace specialized accounting or legal advice when needed.

4) Financial and tax data

The platform provides tools for issuing invoices, reports, and accounts that may be compatible with VAT requirements according to the client's settings. The client remains responsible for verifying the accuracy of settings, declarations, and reports before officially relying on them.

Sand is not liable for financial or tax decisions made by the client based on incomplete data or incorrect settings within their account.

5) Intellectual property

All rights to the platform, website, designs, logos, software, and content published by Sand are reserved to Sand. They may not be copied, resold, or reverse-engineered without prior written permission.

The client retains ownership of the operational and financial data they enter into the platform, and grants Sand a limited license to process it for the purpose of providing the service, technical support, and improving technical performance.

6) Availability, support, and limitation of liability

Sand makes reasonable efforts to keep the platform continuously available, subject to scheduled maintenance or outages beyond its control. Different support levels may be offered depending on the plan or a service level agreement (SLA), if any.

To the extent permitted by law, Sand is not liable for indirect losses, loss of profit, or damages resulting from the client's reliance on data they entered themselves, or from failures at third-party service providers (hosting, email, payments, integrations).

7) Amendments and governing law

Sand may update these terms, and the version published on the website is the authoritative one. Continued use of the platform after an update constitutes acceptance of the updated terms.

These terms are governed by the laws of the Kingdom of Saudi Arabia, and jurisdiction lies with its competent courts unless otherwise agreed in writing.
